Disclaimer:

Current crises of democracy and the rule of law in some European countries raise the question of European standards. For procedures under Article 7 TEU for violation of fundamental principles, as they are currently pending against Poland and Hungary, reference is made to the values of Article 2 TEU. Among these, democracy and the rule of law are prominently featured.

The lecturer regards these as European "constitutional principles" and addresses the question of how far these are legally binding in core areas. In addition, the lecturer examines the significance of "soft law" for the determination and further development of these principles and the role played by the "European Commission for Democracy through Law", the so-called Venice Commission.
